Judge grants Plea to the Jurisdiction and stays all other cases

The cases between the Cities of Teague and Fairfield were heard Wednesday, April 24 before 77th District Court Judge Patrick Simmons.

The City of Teague filed suit against the City of Fairfield in September and the City of Fairfield immediately filed a Plea to the Jurisdiction stating the City of Teague had no right to sue.

In the meantime, other Texas Open Meetings Act (TOMA) violation cases were filed by the City of Teague. It was the TOMA violations Judge Simmons ruled on Wednesday granting the City of Fairfield their Plea to the Jurisdiction.

The main case filed by Teague was a breach of contract regarding the Interlocal Definitive Agreement between the cities for the water and wastewater facilities at the Texas Department of Criminal Justice Boyd Unit between the two cities.
