Cities back in court April 24

The City of Teague and City of Fairfield found themselves before District Court Judge Patrick Simmons Thursday afternoon and it was good and bad news for both Cities by the end of the hearing.

The Plea to Jurisdiction filed by the City of Fairfield was denied by Simmons stating Texas Local Government Codes (TLGC) 271.151 and 271.152 for the lawsuit to move forward.

TLGC 271.151 states, “Adjudication” of a claim means the bringing of a civil suit and prosecution to final judgment in county or state court and includes the bringing of an authorized arbitration proceeding and prosecution to final resolution in accordance with any mandatory procedures established in the contract subject to this subchapter for the arbitration proceedings.

This adjudication refers to contracts with local government entities, municipalities, public school districts and special-purpose districts or authorities.
